These Terms & Conditions (“Terms”) govern all purchases of music equipment (including guitars, amplifiers, microphones, audio interfaces, headphones, and related accessories; collectively “Products”) from SoundWave (“Company,” “we,” or “us”) via our official website, authorized retail stores, or direct sales channels. By placing an order, you (“Customer,” “you”) agree to these Terms, our Privacy Policy, and any additional terms provided at checkout.
1. Order Acceptance & Confirmation
- Your order constitutes a request to purchase Products. We reserve the right to accept, reject, or cancel orders (e.g., due to incorrect pricing, out - of - stock items, suspected fraud, or discrepancies in custom product specifications, such as custom - painted guitars or personalized audio interfaces). A binding contract is only formed when we send an “Order Confirmation” email containing your order number, Product details, and delivery timeline.
- For custom or made - to - order Products (e.g., custom - shaped electric guitars, engraved microphones, or audio interfaces with tailored firmware), a 35% non - refundable deposit is required upon order placement. Within 2 business days, we will provide a digital design mockup or specification sheet for your approval. Production will only commence after you confirm the details in writing. Once production starts, custom orders cannot be canceled, modified, or refunded, unless the finished Product has manufacturing defects not related to your approved specifications.
2. Payment Terms
- We accept major credit cards (Visa, Mastercard, American Express, Discover), PayPal, Apple Pay, Google Pay, and Affirm (for installment plans). All payments are processed in U.S. Dollars.
- Listed prices do not include applicable sales tax (calculated based on your shipping or billing address, whichever is required by law) or shipping fees, which will be added at checkout. We may correct pricing errors (e.g., typos, system glitches) and will notify you immediately. You may cancel the order if you do not agree with the revised price.
- For Affirm installment plans, late fees or interest may apply in accordance with Affirm’s terms. Failed or declined payments may result in order cancellation, and the non - refundable deposit (for custom orders) will be forfeited.
3. Shipping & Delivery
- We ship to all 50 U.S. states, Alaska, Hawaii, Puerto Rico, and Canada. Standard shipping (3–5 business days for domestic orders) costs $9.99; orders over $200 qualify for free standard shipping. Expedited shipping (1–2 business days for domestic orders) is available for $24.99. For Canadian orders, shipping takes 7–10 business days and costs $29.99 (excluding duties and taxes, which are the customer’s responsibility).
- All music equipment is packaged with specialized protection: Guitars are shipped in hardshell cases with foam padding; amplifiers and audio interfaces are wrapped in anti - static bubble wrap and placed in reinforced cardboard boxes; fragile items like microphones include shock - absorbing foam inserts. You must inspect the package immediately upon delivery:
- If the packaging is damaged, or the Product (e.g., a cracked guitar body, a non - functional amplifier, a bent microphone stand) is defective, take photos of the packaging and the damaged Product, then contact our customer support within 48 hours. We will arrange for a free replacement or issue a full refund (including shipping fees) at your option.
- Failure to report damage within 48 hours may invalidate our obligation to provide replacements or refunds.
- Delivery dates are estimates only. We are not liable for delays caused by weather conditions, carrier disruptions (e.g., shipping strikes), or incorrect shipping addresses provided by you.
4. Returns & Refunds
- Eligible non - custom Products may be returned within 30 days of delivery for a full refund (excluding original shipping fees), provided they are unused, unopened (if sealed), undamaged, and in their original packaging (including all accessories, manuals, and tags). For opened but unused Products (e.g., a guitar that was only unpacked but not played), a 10% restocking fee will apply.
- To initiate a return:
- Request a Return Merchandise Authorization (RMA) number via our website or customer support.
- Ship the Product back to us (you are responsible for return shipping costs; we recommend using insured, trackable shipping, especially for high - value items like guitars or amplifiers).
- We will inspect the return within 5 business days of receipt. Refunds will be processed to your original payment method within 7–10 business days if the return meets our criteria.
- Non - returnable items include: custom/made - to - order Products (unless defective), used Products (e.g., guitars with pick marks, amplifiers with signs of wear), clearance items (marked “Final Sale”), and gift cards. Products returned with missing parts (e.g., a guitar missing its strap, an audio interface missing its USB cable) will incur a 15–40% restocking fee (depending on the value of the missing component).
5. Product Warranty
- All SoundWave Products come with a 1 - year limited warranty against defects in materials and craftsmanship (e.g., a guitar neck that warps under normal use, an amplifier that fails to power on due to faulty wiring, a microphone with distorted audio output).
- The warranty does not cover:
- Damage from misuse (e.g., dropping a guitar, exposing an amplifier to water, using a microphone with incompatible power supplies), improper maintenance (e.g., failing to clean guitar strings, not storing audio equipment in a climate - controlled environment), or modifications (e.g., replacing a guitar’s pickups with non - SoundWave parts).
- Normal wear and tear (e.g., minor scratches on a guitar’s finish, faded labels on an amplifier, reduced headphone comfort from extended use).
- Damage caused by third - party repairs (unless performed by an authorized SoundWave service center).
- To claim warranty service: Provide your order number, photos or videos of the defect, and a description of how the Product was used. We will, at our discretion, repair the Product, replace it, or issue a prorated refund. We cover shipping costs for warranty replacements or repairs within the U.S.
6. Intellectual Property
- All content on our website (product images, descriptions, logos, audio samples, and user manuals) is owned by SoundWave and protected by U.S. copyright and trademark laws. You may not reproduce, distribute, modify, or use this content for commercial purposes without our written permission.
- SoundWave trademarks (including the SoundWave logo and product line names like “WaveTone” amplifiers or “ClearVoice” microphones) may not be used in any way that implies affiliation with or endorsement by us, without prior written consent.
7. Limitation of Liability
- We shall not be liable for indirect, incidental, or consequential damages (e.g., missed performances due to a defective amplifier, lost recording projects due to a faulty audio interface, or loss of income) arising from defective Products, shipping delays, or order cancellations. Our total liability for any claim shall not exceed the purchase price of the affected Product.
8. Changes to Terms & Dispute Resolution
- We may update these Terms periodically. Changes will be posted on our website and take effect 7 days after publication. Your continued purchases after the effective date constitute acceptance of the revised Terms.
- Any disputes arising from these Terms shall first be resolved through good - faith negotiation. If negotiation fails, disputes will be submitted to binding arbitration in California (in accordance with the rules of the American Arbitration Association) instead of litigation.
